So let's say someone owned baseballforums.com and it was not trademarked and I bought basebalforums.com , then they decided to trademark it. Wouldn't I be grandfathered in or something?

If you have a domain before it was trademarked and you can prove that you had no wrong intentions... then I guess that might not be any problem

I have no way to prove this but since aquiring this new domain of mine I have seen a boost in uniques by almost 40%.

I need some way of tracking this so I can be sure. I can't figure out where the traffic is coming from and I'm just speculating. But it does seem very likely.

Be VERY careful how you funnel the traffic to your site if you do this. Done incorrectly, it can hurt you in the SERPS.

I personally don't think it's worth it. I'd rather spend my time and money marketing my site correctly.
