Can a husband and wife run a business as a sole proprietor or do they need to be a partnership?

They do not have to be a partnership but you are going to have to have one be the owner and one be the employee good luck with your negotiations

That is my understanding as well.

Be careful about how you do your tax returns (divide your income tax liability); there's a test case in the High Courts on at the moment...
